Terms of Service

These terms are the agreement between you and Hermosa Ventures LLC, a Texas limited liability company at PO Box 830883, Richardson, TX 75083-0883 ("we", "us"), covering your use of STR Optimizer at optimizemystr.com. By subscribing you accept them.
1. What the service is
STR Optimizer sends you a brief by email, once a month, about one short-term rental listing you nominate. Each brief contains some combination of:
- Three ranked suggestions for that month, and whether you completed last month's
- Your rating, review count and category subscores, with the arithmetic of moving them
- Market-level statistics for the area your listing is in
- A count of the themes your guests write about, as published by the listing platform
- Suggested title and description text you can copy
- A section stating what that month's brief could not check
Sections appear only when the underlying data is available. Where we cannot get something, the brief says so rather than filling the gap.
2. What the service is not
The brief is information, not advice, and not a promise of results.
- We do not guarantee that following any suggestion will increase your bookings, your nightly rate, your revenue, your rating or your position in any search ranking. No one can honestly guarantee that, and we do not.
- Market figures are third-party estimates, not measurements. Providers disagree with each other — where ours do, the brief shows you both figures rather than choosing. Treat any market-wide number as an estimate with real uncertainty around it.
- Nothing in a brief is investment, financial, tax, legal or accounting advice. We do not know your costs, your debt, your tax position or your goals.
- We are not responsible for your compliance with local short-term rental rules, zoning, licensing, lodging taxes, HOA restrictions, or the terms of the platform you list on.
3. We are not affiliated with any listing platform
We are not affiliated with, endorsed by, sponsored by, or in any partnership with Airbnb, Inc., Vrbo, Booking.com or any other platform. We read only public listing pages. Platform names are used to identify those services, nothing more. Your relationship with your platform is governed by its own terms, and we have no ability to affect it.
4. Eligibility and your account
You must be at least 18 and able to enter a contract. You must either own or be authorised to manage the listing you submit. You are responsible for the accuracy of the email address and listing URL you give us; a brief sent to an address you mistyped is not something we can recall.
5. Supported listings
At present the brief is produced from Airbnb listings only. We check this at checkout and decline listings we cannot read, rather than taking payment for something we cannot deliver. If we add support for other platforms we will say so on the website.
6. Subscription and billing

Prices are in US dollars and exclude any tax that may apply. Payment is taken by Stripe; we never receive your card number. Your subscription renews automatically at the then-current price for your plan until you cancel. We will give subscribers at least 30 days' notice by email before any price increase takes effect.
Your first brief is produced as soon as you subscribe. Monthly briefs follow on the same cycle as your billing.
7. Cancelling
You can cancel at any time from Manage plan or from the link at the bottom of any brief. Cancellation stops future charges. You keep access through the period you have already paid for, and you keep every brief we have already sent you.
8. Refunds
Our Refund Policy forms part of these terms. In short: within the first 30 days of your first payment we will refund half of what you paid; after that, cancelling stops future charges but does not refund the current period.
9. Acceptable use
A subscription covers one listing. You may use your briefs for your own business, including sharing them with your co-host, property manager or accountant. You may not:
- Resell, republish or redistribute briefs, or use them to provide a service to third parties
- Submit a listing you have no right to submit
- Scrape, reverse engineer or attempt to extract our underlying data or methods
- Attempt to disrupt the service, or use it to break the law or any platform's terms
10. Intellectual property
We own the briefs, the website and everything in them. You get a personal, non-exclusive, non-transferable licence to use your briefs for your own property, including the suggested title and description text, which is yours to publish on your listing. You keep whatever rights you already have in your own listing content.
11. Third-party data
Market statistics come from third-party providers, currently AirROI, and are supplied to you as estimates. We attribute every figure and date it. We are not liable for a provider's errors, outages or discontinuation. If a provider becomes unavailable, the affected section will be omitted from your brief and the brief will say so.
12. Availability
We aim to send a brief every month, but we do not guarantee uninterrupted service. A brief may be delayed or omitted if a listing page becomes unreadable, a data provider is unavailable, or you have changed your listing URL. If we cannot produce a brief in a given month, we will tell you.
13. Disclaimer of warranties
To the fullest extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow these exclusions, in which case they apply to you only to the extent permitted.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost bookings, lost revenue, lost data or lost goodwill, arising out of or relating to the service — whether or not we were told such damages were possible.
Our total liability to you for any claim relating to the service is limited to the amount you actually paid us in the 12 months before the claim arose. Given the price of this service, that is a small number, and you should factor that into how much weight you place on any brief.
Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.
15. Indemnity
You agree to indemnify us against claims arising from your misuse of the service, your breach of these terms, or your submission of a listing you were not entitled to submit.
16. Suspension and termination
We may suspend or end your subscription if you breach these terms, if we are required to by law, or if we discontinue the service. If we discontinue the service, we will refund the unused portion of any period you have paid for.
17. Changes to these terms
We may update these terms. If a change materially affects your rights, we will email subscribers before it takes effect. Continuing to subscribe after that means you accept the updated terms. If you do not, you can cancel.
18. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Texas, and we each consent to their jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your country of residence.
19. General
If any provision is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a sale or reorganisation of the business. These terms, with the Privacy Policy and the Refund Policy, are the whole agreement between us.
